The agreement between you and Boat Name Merch when you browse the site, place an order, or use any service we offer.
Welcome to Boat Name Merch ("we," "us," "our," or the "Company"). These Terms of Service ("Terms") govern your access to and use of the website located at boatnamemerch.com (the "Site"), our online design tools, and any products or services we sell (collectively, the "Services"). By using the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
Boat Name Merch is a custom-merchandise shop based in the United States. We design and sell printed apparel, drinkware, accessories, stickers, flags, and related items personalized with our customers' boat names. All references to "the Company" mean Boat Name Merch and its authorized operators.
You must be at least 18 years of age (or the age of majority in your jurisdiction) to place an order. By placing an order, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.
Every product we ship is custom-made-to-order with the boat name and design specifications you provide at checkout. Once you place an order and payment is confirmed, the order moves to production and cannot be canceled, modified, or refunded. Please double-check spelling, sizing, color, and quantity before completing checkout. If you spot a mistake within one hour of checkout, email Support@boatnamemerch.com immediately — we may be able to stop production.
All prices are listed in U.S. dollars and exclude applicable taxes and shipping. We reserve the right to update pricing at any time; the price applicable to your order is the price displayed at the time you place it. Payment is processed through Stripe. By providing payment information, you authorize us to charge the total order amount, including any shipping and applicable taxes.
Shipping timelines listed on the Site are estimates, not guarantees. We are not responsible for delays caused by the shipping carrier, weather, or other circumstances beyond our control. Title and risk of loss pass to you upon our delivery of the package to the carrier. If a package is lost or damaged in transit, contact us within 14 days of the expected delivery date and we will work with the carrier to file a claim or, at our discretion, reprint and reship the order.
When you provide a boat name, text, photo, logo, or other artwork for printing on a product, you grant us a non-exclusive, royalty-free license to use that content solely for the purpose of producing your order.
You are solely responsible for the content you submit. You represent and warrant that you own, or have all necessary rights, licenses, and permissions to use, any names, words, photographs, logos, or artwork you submit, and that none of it infringes the trademark, copyright, right of publicity, or other rights of any third party.
We do not pre-screen customer submissions for intellectual property compliance. Boat Name Merch is not liable for any third-party claim arising from content you submit, including but not limited to claims of trademark infringement, copyright infringement, or violation of a third party's right of publicity. If a third party asserts such a claim, you agree to indemnify Boat Name Merch as set forth in Section 10.
We reserve the right (but not the obligation) to refuse, cancel, or remove from production any order that, in our sole judgment, appears to infringe a third party's rights, contains profane, hateful, sexually explicit, or otherwise inappropriate content, or violates applicable law.
Because every order is custom-printed to your specifications, we cannot accept returns for change-of-mind, wrong-size-on-apparel, or similar customer-side issues. We will reprint or refund:

We warrant that our products will be free from defects in materials and workmanship at the time of delivery, under normal use. This warranty does not cover normal wear and tear, damage from improper care (e.g., apparel washed at the wrong temperature, drinkware put through a dishwasher when not dishwasher-safe), abrasion, chemical exposure, or modifications made after delivery.
EXCEPT AS EXPRESSLY STATED ABOVE, THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOAT NAME MERCH AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS, INCLUDING WITHOUT LIMITATION LOST PROFITS OR LOST DATA. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO ANY ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER.
You agree to indemnify and hold harmless Boat Name Merch from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) names, words, or artwork you submit that infringes a third party's rights, (b) your misuse of any product, or (c) your violation of these Terms.
These Terms are governed by the laws of the U.S. state and federal jurisdiction designated by Boat Name Merch, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to the personal jurisdiction of those courts. Prior to filing any formal action, you agree to first contact us in good faith to attempt informal resolution.
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be announced on the Site. Your continued use of the Services after a change constitutes acceptance of the revised Terms.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.
